These Terms of Service apply to all users of the Pier Network, including but not limited to:
- The Pier Network for Minecraft
- The Pier.gg website and store
- All items available through Pier Network's in-game services
- All features, functionalities, and components accessible through computer, mobile device, or other device

## 2. Age Restrictions and Parental Consent

## 4. Account Security and Information
### User Responsibility
You are responsible for maintaining the security of your account credentials.
**Pier Network is not responsible for unauthorized access to your account resulting from your disclosure of login information to third parties.**
**IMPORTANT SECURITY WARNING:** Never share your account information, passwords, or payment details with anyone claiming to represent Pier Network. We will never ask for your password, credit card details, full billing address, or Social Security number through unsolicited messages.
### Information Access
We may update or access user information as described in our Privacy Policy. We cannot access your credit card numbers, complete billing information, or Social Security numbers. To verify communications from us, visit our website directly at Pier.gg or email admin@pier.gg. Check our Discord for announcements about any ongoing issues.

## 5. Account Enforcement and Appeals
We reserve the right to suspend, restrict, or terminate accounts that violate these Terms of Service, our Community Rules, or engage in:
- Cheating, hacking, or exploitation
- Harassment or abusive behavior
- Fraudulent purchases or chargebacks
- Any conduct that disrupts our Services or harms other users
- Violation of third-party terms (Mojang, Microsoft, Discord, etc.)
- Any other determined rule breakage or disobedience
### Appeals
If you believe your account action was issued in error, you may submit an appeal through our Discord server. Appeals are reviewed at our discretion, and outcomes are not guaranteed.

## 6. Purchases and Server Support
### Nature of Purchases
All purchases made through Pier Network are voluntary contributions that support our server operations and come with associated perks, ranks, or digital items as a thank-you benefit. While we may refer to these as "donations" in our community, they are transactions where you receive digital items in exchange for your support.
By making a purchase, you acknowledge that:
- Your payment supports server hosting, development, maintenance, and operations
- Perks are provided as benefits for supporting the server
- All purchases are final as described in our refund policy
- Perks may be modified for game balance, compliance with Mojang's EULA, or when seasons change. **We appreciate your support in keeping our community running!**
### Refund Policy
**All purchases are final.** Your payment immediately goes toward server costs (hosting, development, plugins, etc.), making refunds difficult to process. We cannot offer refunds, reimbursements, or exchanges except in the following specific cases:
**We may provide refunds for:**
- Payment processing errors or duplicate charges
- Perks that fail to deliver due to technical issues on our end
- Server permanent closure within 7 days of your purchase
**To request a refund exception:**
Contact admin@pier.gg within 7 days of purchase with your transaction details and explanation.
### Chargebacks and Payment Disputes
**Please contact us before filing a chargeback.**
We want to resolve any legitimate issues with you directly. Fraudulent or unjustified chargebacks will result in:
- Permanent ban from our server and services
- Removal of all perks and ranks
- Blacklist from future purchases
**Legitimate chargebacks won't be penalized:**
If you didn't authorize a charge or there was a genuine payment processing error, contact us first at admin@pier.gg and we'll work with you to resolve the issue.
### "Lifetime" and Season Perks
**What "Lifetime" means:**
Lifetime perks last for the duration of the current server season or iteration. This means perks will remain active until:
- The current server season ends and a new season begins
- The server permanently shuts down
- The specific perk is discontinued by administration
- Major server updates or changes require perk adjustments
When we launch a new season or make major server changes, we may:
- Transfer perks to the new season (most common approach)
- Replace perks with equivalent new-season perks
- Modify perks for game balance or compliance
We will make reasonable efforts to preserve the value of your support across seasons when possible.
### Subscription Services
If we introduce subscription services in the future, they will be subject to these same terms. Subscriptions will last for their stated duration and perks may be modified with notice. All subscription payments are also considered final contributions to server support.
### Perk Modifications
We reserve the right to modify, rebalance, or remove perks and items to:
- Maintain fair and balanced gameplay
- Comply with Mojang's EULA and Microsoft's Terms of Service
- Fix bugs, exploits, or unintended mechanics
- Improve overall server health and player experience
We will avoid removing purchased perks entirely when possible, but functionality, appearance, or effectiveness may change for server health and compliance reasons.

## 7. Third-Party Services and Terms
By using our Services, you also agree to comply with the terms and policies of our third-party service providers, including:

- Microsoft Services Agreement
- Minecraft End User License Agreement (EULA)

- Any other third-party service terms applicable to our platform

## 8. User Conduct
### Prohibited Activities
You agree not to:
- Use cheats, hacks, exploits, mods, or unauthorized client modifications
- Harass, threaten, bully, or abuse other users or staff members
- Impersonate staff members, administrators, or other users
- Attempt to gain unauthorized access to accounts, systems, or server infrastructure
- Engage in fraudulent purchases, payment disputes, or chargeback abuse
- Share or distribute other users' personal information
- Spam, advertise other servers, or distribute inappropriate content
- Use offensive usernames, skins, or builds
- Exploit bugs or glitches for personal gain
- Engage in real-money trading (RMT) outside of our official store
- Violate any applicable laws or regulations
### Staff Conduct
Volunteer staff members agree to these Terms and any additional staff policies provided separately. Staff who disagree with these terms or staff policies must resign from their positions and may not continue as staff members.

## 9. Intellectual Property
All content, designs, logos, builds, plugins, and materials on Pier Network are owned by or licensed to us. You may not copy, modify, distribute, sell, or create derivative works from our content without our express written permission.
**User-Generated Content:**
By creating content on our server (builds, chat messages, etc.), you grant us a non-exclusive license to use, display, and modify that content as part of our Services.

## 10. Service Availability and Changes
### No Guarantee of Availability
We provide our Services on an "as-is" and "as-available" basis. We do not guarantee that:
- Our Services will be uninterrupted, timely, secure, or error-free
- The server will be online 24/7 without downtime
- All features will function perfectly at all times
- Your data will never be lost (though we make reasonable backup efforts)
### Right to Modify or Discontinue
We reserve the right to:
- Modify, suspend, or discontinue any part of our Services at any time
- Change game modes, features, or server configurations
- Reset or wipe server data when launching new seasons
- Perform maintenance that may cause temporary downtime
We will provide reasonable notice of major changes when possible, but are not obligated to do so.

## 11. Limitation of Liability
**TO THE MAXIMUM EXTENT PERMITTED BY LAW:**
Pier Network, its owners, staff, and affiliates shall not be liable for:
- Any indirect, incidental, consequential, or punitive damages
- Loss of profits, data, purchases, or use of services
- Service interruptions, server downtime, or data loss
- Actions or content of other users or third parties
- Any damages resulting from your use or inability to use our Services
- Issues arising from third-party services (Minecraft, Discord, hosting providers, etc.)
**Our total liability for any claim shall not exceed the amount you paid to us in the six months preceding the claim, or $100 USD, whichever is less.**
### User Responsibility
You acknowledge that:
- You use our Services at your own risk
- We are not responsible for lost items, progress, or ranks due to bugs, rollbacks, or server issues
- Minecraft is inherently unstable and issues may occur beyond our control
- You should not share personal or sensitive information in-game or on our platforms

## 13. Dispute Resolution and Governing Law

### Arbitration
For disputes that cannot be resolved informally, both parties agree to attempt mediation before pursuing legal action. If mediation fails, disputes may be resolved through binding arbitration or small claims court.
